Terms of Service

These Terms of Service ("Terms") govern your use of PickyChat ("Service"), operated by PickyChat ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

PickyChat is an AI-powered gift recommendation assistant. You describe who the gift is for, your budget, and preferences through a conversational interface. The Service suggests products from third-party marketplaces based on your input.

2. AI Disclaimer

Recommendations are generated by artificial intelligence and are suggestions only, not guarantees of suitability, availability, or quality. Product information (prices, descriptions, images) comes from third-party sources and may be inaccurate or outdated. Always verify details on the seller's website before purchasing.

3. Third-Party Products and Content

PickyChat does not sell, ship, or handle returns for any products. All purchases are made directly from third-party marketplaces (e.g., AliExpress). We are not responsible for product quality, shipping, customer service, or disputes with sellers.

Product information displayed in the Service — including prices, descriptions, images, and availability — originates from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this information. Prices may vary by region and are estimates that may differ from the final price on the seller's website.

4. Affiliate Disclosure

Product links may contain affiliate tracking. PickyChat may earn a commission when you purchase through these links at no additional cost to you. This does not influence which products are recommended — recommendations are based solely on your stated preferences and our ranking algorithm.

5. User Content and License

Your conversations are processed to generate recommendations. You retain ownership of your input. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to process your conversations through our AI systems and third-party AI providers solely for the purpose of providing the Service to you.

By using shared links, you consent to making the conversation summary and recommended products visible to anyone with the link. You may delete shared links at any time.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to extract or scrape data from the Service
  • Interfere with or disrupt the Service's operation
  • Impersonate others or provide false information
  • Use automated tools to access the Service without permission
  • Use the Service to create a competing product or service

7. Age Requirement

You must be at least 13 years old to use the Service. If you are under 18, you should use the Service with parental or guardian consent.

8. Account and Access

The Service can be used with or without an account. Creating an account (via Clerk authentication) enables conversation history and session persistence. We reserve the right to suspend or terminate access for violations of these Terms.

9. Modification and Termination

We may modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRODUCT RECOMMENDATIONS WILL BE SUITABLE FOR YOUR NEEDS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY PURCHASES MADE THROUGH RECOMMENDED PRODUCT LINKS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless PickyChat and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will indicate the effective date at the top of this page.
